These Terms of Service ("Terms") govern your use of the West-End Septic & Pumping website and your engagement of our septic services. Please read them carefully before booking a service or using our website.
By accessing our website, requesting a quote, booking an appointment, or engaging us to perform septic services, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.
These Terms apply to all visitors, customers, and others who access our website or engage our services. Where a separate written service agreement or estimate has been signed by both parties, that document controls in the event of a conflict with these Terms.
1. Acceptance of Terms
By using our website at westendseptic.top, contacting us, booking an appointment, or authorizing us to perform any septic service, you represent that:
- You are at least 18 years of age and legally capable of entering into a binding agreement
- You have the authority to authorize service at the property in question (as owner, tenant, property manager, or authorized agent)
- All information you provide to us is accurate, current, and complete
- You accept these Terms and our Privacy Policy
2. Our Services
West-End Septic & Pumping provides residential and commercial septic services, including:
- Septic tank pumping and complete pump-outs
- Septic system inspections and real estate certifications
- Septic system repairs (baffles, pumps, distribution boxes, lids, and pipes)
- Commercial grease trap and interceptor cleaning
- Emergency septic service, available 24 hours a day, 7 days a week
- Ongoing maintenance plans and service contracts
Service descriptions on our website are for general informational purposes. The specific scope of any service we perform is defined by the estimate or work order you approve before work begins. We reserve the right to refuse service for any lawful reason, including but not limited to unsafe working conditions, inaccessible properties, or unpermitted systems.
3. Booking & Scheduling
Appointments may be requested through our website, by phone at (951) 520-1020, or by email. Submission of a booking request does not create a confirmed appointment until we contact you and confirm the specific date, time window, and scope of work.
- Confirmation: We confirm most booking requests within 30 minutes during business hours. Requests submitted outside business hours are confirmed on the next business day.
- Arrival window: We provide a 2-hour arrival window for most services. Our technician will call or text before arriving whenever possible.
- Delay notification: If we are running late due to traffic, weather, or a previous job running long, we will notify you as soon as we know. Your time matters to us.
- Emergency service: Emergency dispatch is prioritized and may bypass standard scheduling. Emergency surcharges apply as described in Section 4.
4. Pricing & Payment
All pricing is quoted in U.S. dollars. Standard pricing ranges are published on our Pricing page, but the actual price of any specific job is confirmed in writing before work begins.
Estimates and Quotes
- Phone and online estimates are non-binding until confirmed on-site or in writing.
- The price quoted on arrival is the price we charge. If we discover conditions that materially change the scope of work (hidden damage, unexpected access issues, etc.), we will stop, explain the situation, and give you a revised written quote before proceeding.
- No additional work will be performed without your express approval.
Payment Terms
- Payment is due upon completion of service unless a separate written agreement specifies otherwise.
- We accept cash, check, and all major credit and debit cards.
- Commercial accounts may be eligible for net-30 invoicing upon approval.
- Returned checks are subject to a $35 processing fee, as permitted by California Civil Code § 1719.
- Invoices unpaid after 30 days may accrue interest at the rate of 1.5% per month or the maximum rate permitted by law, whichever is lower.
Emergency Surcharges
Emergency service performed outside regular business hours carries a surcharge, which is disclosed on the phone before dispatch. Current surcharges are:
- After-hours weekday and Saturday: $150 – $250 above standard rates
- Sundays and major holidays: $250 – $400 above standard rates
Taxes
Prices do not include applicable sales or use taxes, which will be added where required by California law.
5. Cancellation & Rescheduling
We understand that plans change. Our cancellation policy is designed to be fair to both parties:
- Standard appointments: You may cancel or reschedule at no charge with at least 24 hours' notice.
- Late cancellations: Cancellations with less than 24 hours' notice may incur a $75 fee to cover lost route time.
- No-shows: If our technician arrives at the scheduled window and cannot access the property or reach you, a $100 trip fee may apply.
- Emergency service: Once a technician is dispatched for an emergency call, cancellation is not available. If you cancel after dispatch, the emergency dispatch fee applies.
- Our cancellations: In the rare event we must cancel or reschedule, we will notify you as soon as possible and offer priority rebooking at no additional charge.
6. Site Access & Preparation
To perform service safely and efficiently, we require reasonable access to the septic system. You agree to:
- Provide safe, unobstructed access to the tank, distribution box, and drain field area
- Ensure gates are unlocked, pets are secured, and vehicles are moved as needed
- Disclose any known hazards, including underground utilities, fragile surfaces, structural weaknesses, or hazardous materials
- Provide accurate information about the system's location if known
If access is unsafe or restricted, we reserve the right to suspend service. Additional charges may apply if extra labor or equipment is required to gain access to the tank (such as hand-digging a buried lid or moving heavy obstructions).
We are not responsible for damage to unmarked underground utilities, irrigation lines, or landscaping elements that were not disclosed before work began. California law requires you to mark private utilities before excavation — if you are unsure how to do so, contact us and we can advise.
7. Warranty & Guarantee
We stand behind our work. Our warranty terms are:
Workmanship Guarantee
- All labor and workmanship are guaranteed for 30 days from the date of service.
- If a problem we addressed recurs within 30 days due to our workmanship, we will return and correct it at no additional labor charge.
- This guarantee does not cover new problems, damage from misuse, acts of nature, or issues caused by third parties.
Parts & Equipment
- Parts and equipment we install carry the manufacturer's warranty. We will provide documentation of warranty coverage on request.
- Manufacturer warranties typically range from 1 to 5 years depending on the component.
- Warranty claims for parts are handled according to the manufacturer's terms and may require the part to be returned for inspection.
What Is Not Covered
- Pre-existing conditions that were disclosed to you before service
- Damage caused by root intrusion, shifting soil, or earthquakes
- Damage from improper use after service (flushing prohibited items, overloading the system)
- Damage from chemical drain cleaners or other substances introduced by you or a third party
- System failure due to age or normal wear beyond the intended service life
This warranty is in addition to, and does not limit, any rights you may have under California law, including the Song-Beverly Consumer Warranty Act where applicable.
8. Limitation of Liability
To the fullest extent permitted by California law:
- Our total liability arising out of or related to any service we perform shall not exceed the amount you paid for that specific service.
- We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost business, or damage to unrelated property.
- We are not liable for damage caused by conditions we could not reasonably have discovered during a routine service visit, including hidden damage to drain fields or underground piping.
- We are not liable for service delays caused by events beyond our reasonable control, including severe weather, road closures, utility failures, or municipal restrictions.
Some jurisdictions do not allow the exclusion or limitation of certain damages. If any part of this section is held unenforceable, the remaining portions shall remain in full effect.
9. Indemnification
You agree to indemnify, defend, and hold harmless West-End Septic & Pumping, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or related to:
- Your breach of these Terms
- Your violation of any law or the rights of a third party
- Inaccurate or incomplete information you provided about the property or system
- Damage to undisclosed utilities, structures, or landscaping on the property
10. Website Use
When using our website, you agree not to:
- Use the website for any unlawful purpose or in violation of any applicable law
- Attempt to gain unauthorized access to any part of the website or its systems
- Interfere with or disrupt the website's operation or servers
- Submit false, misleading, or fraudulent information through any form or communication channel
- Scrape, copy, or republish content from the website without our written permission
- Use automated systems (bots, scrapers) to access the website in a manner that places excessive load on our infrastructure
We reserve the right to suspend or terminate access to our website for any user who violates these Terms.
11. Intellectual Property
All content on this website — including text, graphics, logos, images, icons, code, and layout — is the property of West-End Septic & Pumping or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any part of this website for commercial purposes without our prior written consent. Personal, non-commercial use (such as printing a page for your own reference) is permitted.

12. Dispute Resolution

Informal Resolution
If a dispute arises, both parties agree to attempt to resolve it informally for at least 30 days before initiating formal proceedings. This period may be extended by mutual written agreement.
Small Claims Court
Either party may bring an individual action in small claims court in Riverside County, California, if the claim qualifies and remains in that court.
Binding Arbitration
Any dispute not resolved informally or in small claims court shall be resolved through binding arbitration administered in Riverside County, California, in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted on an individual basis only — class actions and consolidated claims are not permitted. Judgment on the award may be entered in any court with jurisdiction.
Exceptions
Either party may seek injunctive relief in a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Subject to Section 12 above, any legal action or proceeding shall be brought exclusively in the state or federal courts located in Riverside County, California, and you consent to the personal jurisdiction of those courts.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision of these Terms shall not be construed as a waiver of that provision.
14. Changes to These Terms
We may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices. When we make material changes, we will update the "Effective Date" at the top of this page and, where appropriate, provide notice on our website.
Your continued use of our website or services after the effective date of any update constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you should stop using our website and services.
